TERMS OF SERVICE

Thank you for engaging Peach Perfect for your special event. By placing an order for goods via our website, email, telephone or any other means, you confirm you agree to the below Terms and Conditions.

The words ‘you’ and ‘your’ used throughout the Terms and Conditions refers to the buyer/client. The words ‘we’, ‘our’ and ‘us’ used throughout these terms and conditions refers to Peach Perfect, the seller.

GENERAL

Your Use of our Website (www.peachperfect.com.au) constitutes your agreement to adhere to and be bound by the following Terms and Conditions. Peach Perfect reserves the right, at any time, to modify, alter or update our Website, policies and these Terms and Conditions. By continuing to use our website after we post any such changes, you will be deemed to have accepted any and all such changes.  

ORDER ACCEPTANCE 

All orders are subject to verification and acceptance. All billing information provided must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms and Conditions and may result in cancellation of your order. 

Peach Perfect reserves the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information. If your order is cancelled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the product(s). 

PAYMENT TERMS, CANCELLATIONS AND POSTPONEMENTS

We understand that sometimes things happen that may be unexpected or out of your control. You are welcome to cancel or postpone your order at any stage. Please refer to the following terms that apply to cancelled / postponed orders (including cancelling or postponing due to Covid or other emergency situations):

1. Cancellation of semi-custom stationery
Semi-custom stationery is any design purchased directly from our website by you with no request for changes to our design template other than replacing the template wording with your personalised wording.

(a) Prior to commencement of design: If your order is cancelled within 24 hours of order placement and we have not sent a design proof, a full refund will be provided. If your order is cancelled after 24 hours  of order placement, a fee of AUD$15.00 will apply to cover administration of your order. 

(b) Prior to print approval: A fee of AUD$35.00 will apply to cover administration of the order. An additional AUD$25.00 fee will apply to each design proof that has been emailed to you. 

(c) After you have approved your design for print: If an order is cancelled / postponed after you have provided written approval for print and/or production, no refund can be provided unless there is a print error on our behalf, in which case Peach Perfect will reprint or resupply with corrections made in the fastest time possible. A printed error on our behalf is where the printed item differs to the final digital proof that was approved by the customer. 

2. Cancellation of custom stationery
Custom stationery is any design purchased directly from our website with design changes required (including font changes and changes to or additions of design elements) or any design ordered separately from our website as a new design. In the event of cancellation, Peach Perfect retains complete ownership of any and all copyrights and original work created and has the right to use these items or designs without exception or restriction. The designs provided are not released to you and cannot be used by or replicated by another designer. Please refer to our Copyright section.

(a) Prior to commencement of design: A fee of 25% of the total order cost or AUD$100.00 (whichever is the less amount) will apply to cover administration of the order. This Administration fee covers the time taken for research, processing your order and/or correspondence and/or payment processing.

(b) Prior to print approval: A fee of AUD$100.00 will apply to cover administration of the order. An additional AUD$80.00 fee will apply to each design proof that has been emailed to you. 

(c) After you have approved your design for print: If an order is cancelled / postponed after you have provided written approval for print and/or production, no refund can be provided unless there is a print error on our behalf, in which case Peach Perfect will reprint or resupply with corrections made in the fastest time possible. A printed error on our behalf is where the printed item differs to the final digital proof that was approved by the customer. 

Peach Perfect reserves the right to reduce or cancel any of the above cancellation fees at their discretion.

POSTPONEMENT

You are welcome to postpone your order or services with us at any time prior to Peach Perfect receiving your written approval to print. We will hold your order for 6 months and rely on you to notify us to re-start your order. We will then re-confirm the price of your order. 

DESIGN 

1. Semi Custom Stationery
The design is exactly as shown our our website. Not included in the price are any changes to the design, font, or print colours. These are offered at an additional cost and are priced on application.

2. Custom Stationery

We design as close as possible to the inspiration provided by you / discussed with you. If you do not accept the design/s provided to you according to what we had agreed to, we will stop designing and discuss options with you. If we have established that we have not met your design brief, then we will present a new design on one of the products only (not the full suite) at our cost and will provide one new concept within the earliest time possible. If you decide to cancel your order at this stage refer to our Cancellation section above.

PROOFING

We provide digital proofs of your concept / design to the email address provided by you when ordering to confirm the content of the design is accurate. As our products are personalised for you, we are unable to accept returns or refunds. We encourage you to take great care to ensure the accuracy of each order before providing approval to print. Errors that are approved by you at proof stage (including spelling errors) will be reprinted at your expense and only on payment clearance. Peach Perfect will not print any order until receiving your written confirmation to proceed with printing or written approval of design content. 

PROVIDING GUEST LISTS / VARIABLE DATA

If your order requires you to provide a guest list for design and printing of your guest names and / or addresses, we will provide you via email with a ‘template spreadsheet’ to provide us with your list. The template spreadsheet will include a separate tab with variable data Terms and Conditions. It is your responsibility to ensure the list you provide us with is correct. If you have made a mistake with your list prior to Peach Perfect adding your guest names / addresses to your design, you can provide a new list at no charge. At the stage where we have commenced adding your guest names / addresses to your design and alterations to your list are requested by you:

(a) We will make your alterations at no cost to you if there are less than 10 changes required. This will require a new digital proof which is classified as one of your complimentary proofs. Your changes will only be accepted typed in an email. 

(b) We will make your alterations and charge an AUD$15.00 Design Amendment Fee where you require 10 -15 changes.This will require a new digital proof which is classified as one of your complimentary proofs. Your changes will only be accepted typed in an email. 

(b) We will make your alterations and charge an AUD$30.00 Redesign Fee if 15 or more changes are required.Your changes will only be accepted with you supplying us with a new guest list.

DESIGN ALTERATIONS

The price includes the placement of your wording/images into your chosen theme/layout, or the creation of your custom design with your wording/images. The number of alterations provided per order is included on each product page and varies with each product. Additional alterations after you have received your complimentary alterations will be charged an AUD$15.00 Design Amendment Fee per digital proof supplied.

Any request that requires a revised email proof is considered an alteration, with the exception being a completely new design / layout. If a new design is requested, Peach Perfect will advise revised costs based on additional design time required.   

Alterations to your order may be made until the final PDF proof is approved for printing. Once approved, no alterations can be made. Your written email approval to Peach Perfect will confirm your approval to print. If alterations are required after print approval has been provided, an AUD$30.00 Redesign Fee will be charged for up to 3 alterations. More than 3 alterations will require you to place a new order. It is at our discretion as to whether we will/can offer a new order and whether we may offer this at a discounted rate. 

POSTAGE AND SHIPPING

Peach Perfect will do everything possible to ensure your stationery arrives in perfect condition and as quickly as possible. Please refer to our 'Proofing, Turnaround, Shipping' information page for details on delivery timeframes as they will vary depending on the product ordered.

Please note that Peach Perfect is not responsible for delivery delays due to unforeseen issues outside of our reasonable control such as delays due to severe weather, natural disasters or strikes, or damaged or lost goods caused by shipping services.

If shipping is required more than once per order, a second shipping fee will be charged.

We charge a flat fee for shipping within Australia ($AUD). Some products do not have a shipping fee as noted on the product page. All products will be shipped via a traceable service with Australia Post or other shipping company unless the client requests otherwise. Express shipping will incur an additional fee.

International Shipping: You are liable for additional customs and import duty, quotas, permits, product restrictions and other local requirements.

PRINTED COLOURS

Colours will be as close as possible to the artwork that appears on our website or on your computer screen, however Peach Perfect is not responsible for slight colour variations of printed products. Printed products may have slight variations in colour caused by the following which are not within our control (1) Your computer monitor could be colour calibrated in a particular way (2) Computer monitors display colours in RGB, which is different to the CMYK print process (3) Printed ink will sit differently on different paper stocks.

PHOTO SUBMISSION

Peach Perfect is committed to protecting photographers’ copyrights. It is solely and without exception the responsibility of the customer submitting photo/s to ensure that they have the permission of the copyright owner to use the image. By sending your photo to Peach Perfect designs you warrant that:

(a) It is your own original work or that you have the written permission of the copyright owner, parent or guardian and that you have the right to make it available to Peach Perfect;

(b) It does not infringe any law; and

(c) You indemnify Peach Perfect against all legal fees, damages and other expenses that may be incurred by Peach Perfect as a result of any breach of the above.

We will only accept photos via email or website upload. We will not accept hard copy photos or scanned photos. Peach Perfect will advise to the best of our ability if your photos are suitable enough quality to print from. Peach Perfect reserves the right to refuse to use images that are not of suitable quality. Peach Perfect will not be responsible for variations in colour/quality due to our printing processes, or for flaws in the image that you have supplied us.

PRODUCT AVAILABILITY 

Product availability and printing services advertised on our website are not guaranteed. Peach Perfect uses third party services to provide optional and non-optional services, including calligraphy, papers, printing, envelopes, cardstock and embellishments. Products and services may not always be available at the time of your order. If a product or service offered on our website is not available by the time your order processes, we will notify you via email and speak with you about your options. 

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise noted, the design of the Website, the Website as a whole, and all materials that are part of the Website embody, use and/or display copyrighted works, trademarks, trade dress or other intellectual property owned, controlled or licensed by Peach Perfect. Any use of the contents without our express written consent is strictly prohibited. 

PRIVACY AND TERMS OF USE

Your use of this Website is governed by the Peach Perfect Privacy Policy (“Privacy Policy”). Peach Perfect reserves the right to change the Privacy Policy at any time, at its sole discretion. For additional information, please see the Privacy Policy.

WARRANTY DISCLAIMERS

We will use our reasonable best efforts to ensure the accuracy of the content on our site. We make no representations or warranties that the functional aspects of our site will be uninterrupted or error-free, or that our site or the server that makes it available are free of viruses or other harmful components. By using this site you acknowledge that its use is at your own risk. As a convenience, our web site may link to other websites that may be of interest to you but are not under our control. These links do not imply an endorsement by Peach Perfect and we take no responsibility for the content of these sites.

INDEMNITY

You agree to defend, indemnify and hold harmless Peach Perfect, and any parent, subsidiary, affiliate, director, officer, employee, licensor, distributor, supplier, agent, reseller, owner, or operator of Peach Perfect, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Website; (ii) your violation of any of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Website.

PRICING

The prices displayed on the Website is quoted in Australian dollars, unless otherwise indicated. 

APPLICABLE LAW

The law applicable to the interpretation and construction of these Terms of Use  and any transaction (including purchases made on this Website) using or related to the Website, shall be the laws of the State of Queensland, Australia, without regard to principles of conflict of laws. You agree that all matters relating to your access to or use of the Website, including all disputes, will be governed by the laws of Australia and by the laws of the State of Queensland. All proceedings relating to the Website, these Terms of Use, or any transaction, including the

sale of any products, using this Website, shall be brought only in the state or federal courts of Queensland, Australia, and you and Peach Perfect do hereby consent to the jurisdiction and venue of such courts.
